TRUST ADMINISTRATION SERVICES

Allen Estate Administration Services is owned and operated by Anne Cotton Allen. Anne has worked in the legal services field for over 40 years and has specialized in estate settlement (probate and trust administration) for over 25 years.  In April 2000, she completed the Advanced Course of Study on Trust Administration produced by CEB (Continuing Education of the Bar). Her clients find her to be very knowledgeable, professional, friendly, and her fees reasonable.

All Trust Administration Documents are prepared in compliance with the California Probate Code which governs trust administration in California.  The core documents include:

  • Notification by Trustee of Trust Administration, Proof of Service by Mail.
  • Certification of Trust, including obtaining new EIN for the Trust.
  • Inventory and Appraisal form to show assets and values as of date of death.
  • Affidavit of Death of Trustee or Joint Tenant, and County Assessor forms required for each real property held in the trust or joint tenancy.
  • Agreements between beneficiaries, if needed, are drafted by an attorney.
  • Receipts by Beneficiaries and mailing the distribution checks.
  • Final Report by Trustee provided to beneficiaries who have 3 years to object to any action taken by the Trustee. If required, the Report will include an accounting.

Other services available are:

    • Reviewing the trust distribution language to determine the steps necessary to carry out the trust terms, including special needs trusts, if needed.
    • Referral to trusted Financial Advisor for guidance on distribution of investments to trust beneficiaries and/or holding of investments in trust
    • Referral to trusted CPA for tax advice and filings
    • Referral to trusted real estate agent, real estate appraiser, estate liquidator
    • Referral to trusted attorney for probate and trust litigation matters
